Abstract
The first questions arising in a dispute in connection with an international travel or tourism contract between a traveller and an organizer respectively a service provider (e.g an airline) are 1. the international jurisdiction respectively the validity of an eventual choice-of-forum clause; 2. the applicable substantive law respectively the validity of an eventual choice-of-law clause. (...) In contrast to the intention of the European legislative bodies the EU Private International Law and International Civil Procedure rules are not consistent and every new secondary legislation act on the one hand solves several problems but on the other hand it entails several new. It is again on the European Court of Justice to find solutions exercisable erga omnes.
